(ORAL) Petitioner has preferred this petition for the issuance of an appropriate writ, especially in the nature of mandamus, directing respondent nos.2 and 3 for taking strict action against respondent no.4, who has allegedly constructed a ramp in the public street by way of encroachment of public land. Petitioner has also prayed for removal of the alleged construction.
Earlier CWP No.1835 of 2022 was filed and the same was ordered to be dismissed as withdrawn with liberty to the petitioner to file a fresh petition with better particulars. Learned counsel for the petitioner submits that precisely for the grievance in question, his legal notice dated 06.03.2022 is pending before respondent no.2. At this stage, the petitioner would be satisfied in case his legal notice is ordered to be decided by respondent no.2 in a time bound manner in accordance with law.

In view of the nature of order which this Court proposes to pass there is no necessity of calling upon any response from the respondents at this stage, as no order prejudicial to the interest of anyone is being passed. This writ petition is disposed of by directing respondent no.2 to decide the legal notice dated 06.03.2022 and to pass an appropriate order in accordance with the provisions of Municipal Act without being influenced by any observation made by this Court in the preceding para preferably within a period of one month from the date of receipt of certified copy of this order.
