(ORAL) Through this petition under Section 439 Cr.P.C., petitionerRajinder @ Raju, has prayed for grant of regular bail in case FIR No. 155 dated 12.05.2018, registered under Sections 420, 467, 468, 471 and 120-B IPC at Police Station Sector-17, Chandigarh. According to prosecution, the petitioner by printing fake cheques of complainant-Company and forging signatures of its authorized person, committed cheating, fraud and forgery for around `4,45,330/-.

Learned counsel inter alia contends that all the co-accused of petitioner, three in number, have been enlarged on bail. Petitioner is in custody since 16.05.2018. Conclusion of trial may take a long time, inasmuch as, as on date only one witness has been examined by the prosecution. No useful purpose would be served by detaining him in jail. CRM-M-7438-2019 -2Nothing has to be recovered from him. He is the first offender. On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner submitting that petitioner is the main accused.

Considering overall facts and circumstances, but without expressing any opinion on the merits of case, the petition is allowed. Consequently, petitioner-Rajinder @ Raju, is ordered to be released on bail pending trial, if, not required in any other case, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
