RAMENDRA JAIN, J. (ORAL) Complainant has filed instant application under Section 378(4) Cr.P.C. for grant of leave to appeal against the order of the trial Court dated 30.07.2014, dismissing his complaint under Sections 166, 167, 499, 500 and 501 read with Sections 109, 34 and 120-B IPC against the respondents, after recording preliminary evidence.
Instant application was filed by the applicant on 11.11.2014. Since then the same has been taken on board for eight times, out of which on six occasions, adjournment was sought by learned counsel for the applicant on the ground of personal difficulty or due to non-availability and on two occasions, applicant has gone unrepresented or his counsel has never made any effort to agitate his grievance before the Court. Resultantly, adverse inference can safely be drawn against the applicant and his counsel that they are no more interested in pursuing instant application.
