Prayer in the present writ petition is for deciding the applications filed by the petitioners for regularization of their unauthorized constructed houses as per Section 5-A (1) Haryana Village Common Lands (Regulation) Act, 1961 (hereinafter referred to as 'the 1961 Act') read with Rule 15-A of the Punjab Village Common Lands (Regulation) Rules 1964 (as applicable to State of Haryana), in a time-bound manner.

Learned counsel for the petitioners has contended that the applications are still pending and no decision has been taken on the same. 3.

Notice of motion.

Mr. Saurabh Mago, DAG Haryana, accepts notice on behalf of respondent Nos.1 to 4/State. On instructions from Mr. Naveen Kumar, BDPO, Bhiwani, the learned counsel states that the petitions under Section 7 of the 1961 Act were filed by the Gram Panchayat, wherein eviction orders were passed, which have not been appended with the present petition. CWP-3749-2026 (O&M) been stated that possession has already been taken by the Gram Panchayat from Sh. Kelash Chander son of Sh. Deshraj, Sh. Balbir son of Sh. Gulab, Sh. Kartar Singh son of Sh. Pirthvi Singh, Sh. Bajrang Lal son of Sh. Ram Kumar, Sh. Pawan Kumar son of Sh. Prithi and Smt. Rami Devi wife of Sh. Balwan Sharma (petitioner Nos.4, 5, 6, 8, 9 and 10 herein). It is further stated that the applications would be decided within a period of four weeks from today. Learned State counsel has further assured that till such time as the applications are not decided, status quo would be maintained qua possession with regard to petitioner Nos.1, 2, 3 and 7 only since possession has already been taken from petitioner Nos.4, 5, 6, 8, 9 and 10.

In view of the above, the present writ petition is disposed off without commenting on the merits of the case, with a direction to respondent No.5-Gram Panchayat, Mandhana, to take a decision on the applications filed by the petitioners, in accordance with law, expeditiously preferably within a period of four weeks from today. Till the decision is taken, status quo qua possession of petitioner Nos.1, 2, 3 and 7 would be maintained. 6.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
