Instant petition has been filed under Section 439 Cr.PC for grant of interim regular bail to the petitioner in case FIR No.390 dated 21.12.2023 under Sections 15/61/85 of NDPS Act registered at Police Station Derabassi District SAS Nagar, Mohali for a period of two months to attend the Bhog ceremony of his mother, who expired on 04.02.2024. 2.

While drawing the attention of this Court to Annexure P-3 learned counsel for the petitioner submits that the mother of the petitioner has expired on 04.02.2024 and her last rites/Bhog is to be performed between 1.00 pm to 2.00 pm on 16.02.2024 at Khateek Dharamshala, Dera Bassi, District Mohali for which the presence of the petitioner is essential.

On the asking of Court, Mr. Amandeep Singh Samra, AAG, Punjab, accepts notice on behalf of the respondent-State. 5.

CRM-M-8254-2024 -22024:PHHC:021778 counsel for the petitioner and that the mother of the petitioner indeed expired on 04.02.2024 and her Bhog ceremony of his mother is to take place at Khateek Dharamshala, Dera Bassi, District Mohali on 16.02.2024 from 1.00 pm to 2.00 pm.

I have heard learned counsel for the parties. 7.

The petitioner shall be taken under police escort to the place of the Bhog ceremony i.e. Khateek Dharamshala, Dera Bassi, District Mohali on 16.02.2024 at 09:00 am and would be escorted back to the Jail ,where he is presently lodged on the same day by 05:00 P.M. All travel expenses incurred by the authorities concerned, shall be borne by the petitioner.

The petition stands disposed of accordingly.
