**** HARKESH MANUJA, J. (ORAL) By way of present petition filed under Section 482 CrPC, prayer has been made for issuance of directions to official respondents to conduct fair investigation by some independent agency in case FIR No.31 dated 04.02.2023 under Sections 148, 149, 302 and 506 IPC and Section 25 Arms Acts, 1959 registered at Police Station Punhana, District Nuh and also to safeguard the life and personal liberty of the petitioner and their family members.
Learned counsel for the petitioner submits that initially in the year 2017, the family of Samshu killed the son of Hassan and a trial to this effect is going on. He further submits that during the said trial now family of Samshu has killed his brother Nasruddin and are even openly extending threats to the other family members. He also submits that even a detailed representation to this effect has also been submitted to the office of Inspector of Police Staion, Punhana, Nuh (P-2) on 08.02.2023 (P-2), however, no action has been taken thereupon. He submits that one of the
CRM-M-8533-2023 -2accused named in the aforementioned FIR, namely Sadil, is still roaming freely and thus there is reign of terror in the entire locality. Mr. Rakesh Kumar Ambavta, Addl. A.G., Haryana on instructions from Inspector Arvind Singh submits that the investigation in the aforementioned FIR is going on and one of the accused namely Mohammad Irshad has been apprehended by the Investigating Agency who was arrested on 15.02.2023 whereas all necessary efforts are being made to arrest the other accused namely Sadil. Learned State counsel also informs this Court that adequate arrangements have been made so as to protect the life and liberty of the petitioner and his family members.
He further submits that in case the petitioner still has grievance about any threat perception he may approach the concerned SP who shall take all necessary steps for providing adequate safety to the petitioner and his family. In view of aforesaid, learned counsel for the petitioner at this stage submits that he does not press this petition with liberty to approach the office of Superintendent of Police, Nuh who shall pass necessary orders upon consideration of threat perception, if any, to the petitioner or his family members.
Disposed of accordingly.
