-.- JAISHREE THAKUR J. (ORAL) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.38 dated 05.02.2021 under Sections 323, 452, 506, 120-B, 34 IPC registered at Police Station Old Sabji Mandi, Rohtak.

Counsel for the petitioner inter alia would contend that the petitioner herein has been falsely implicated in the said matter and the FIR has been registered only to settle the personal grudge. It is argued that the offences under Sections 452, 323, 506, 34 IPC would not be made out against the petitioner as she was not named in the FIR. It is argued that the petitioner is in custody since 11.02.2021 and therefore, further custodial interrogation of the petitioner would no longer be required. Learned counsel appearing for the respondent-State opposes the bail application of the petitioner by contending that no ground for grant of bail to the petitioner is made out.

CRM-M No.10004 of 2021 (O&M) -2I have heard learned counsel for the parties. Keeping in view the fact that the investigation is complete and the challan stands presented and the trial is likely to take some time to conclude, no useful purpose would be served by keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
