Budhiya Devi And ORS v. Jaskaran Singh And ORS
IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH
FAO-1684-2019(O&M) Date of decision: 28.11.2019 Smt. Budhiya Devi and others ..... Appellants
Versus
Jaskaran Singh and others ..... Respondents
CORAM:
HON'BLE MR. JUSTICE RAMENDRA JAIN PRESENT: Ms. Priyadeep, Advocate for Mr. Ashwani Arora, Advocate for the appellants. Mr. Vinod Gupta, Advocate for respondent No. 3. Service of respondents No. 1 and 2 already dispensed with vide order dated 02.09.2019.
RAMENDRA JAIN, J. (ORAL) Through this appeal, the appellant-claimants have sought enhancement of compensation, modifying impugned Award dated 12.11.2018 of the Motor Accident Claims Tribunal, Chandigarh (for short 'the Tribunal').
At the outset, learned counsel for respondent No. 3-Insurance Company submits that there is no scope of any enhancement as the appellant-claimants have already been compensated adequately, in accordance with principles laid down by the Apex Court in National Insurance Company Ltd. Vs. Pranay Sethi and others, 2017 (4) RCR (Civil) 1009.
Learned counsel for the appellants has not been able to refute the above submission.
Hence, finding no merit in the instant appeal, the same is dismissed.
