(ORAL) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.276 dated 20.09.2020 under Section 365 IPC (Sections 365, 376, 506, 201 IPC, Section 3(2) (v) of SC & ST Act, 1989 and Section 67 of I.T. Act added later on) registered at Police Station Nissing, District Karnal and chargsheeted under Section 365, 376 (2), 506 IPC and Section 3(2) (v) of SC & ST Act, 1989.
Counsel for the petitioner prays for grant of regular bail to the petitioner by contending that false allegations have been levelled against the petitioner as would be evident from the fact that a compromise has been arrived at between the parties. It is further argued that in fact the matter stands settled between the parties by way of compromise dated 25.02.2021. At this stage, appearance has been caused on behalf of the respondents No.2 and 3/complainant through counsel, who submits that the complainant would have no objection in case the petitioner is allowed regular bail as the matter stands compromised. I have heard learned counsel for the parties. Keeping in view the fact that the matter between the parties stands compromised and the trial is likely to take some time to conclude, no useful purpose would be served by keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
