(ORAL) Learned counsel for the petitioner argues that though the petitioner had retired from service on attaining the age of superannuation on 28.02.2019, but his pensionary benefits were released after undue delay, hence, he is entitled for the interest on the delayed payments keeping in view the law laid down by the Full Bench of this Court in A.S. Randhawa Vs. State of Punjab and others, 1997(3) SCT 468. Learned counsel for the petitioner further argues that the respondents are liable to be directed to grant the interest for compensating the petitioner for the delay, which was caused by the respondents in releasing his pensionary benefits.

Learned counsel for the petitioners states that for the relief, which has been sought in the present writ petition, petitioner has served respondent No.3 with a legal notice dated 22.12.2019 (Annexure P-4), NARESH KUMAR 2020.03.03 10:53 I attest to the accuracy and integrity of this document Chandigarh

CWP-4365-2020 -2which is still pending consideration with respondent No.3 and the petitioners will be satisfied, at this stage, in case a time bound direction is issued to respondent No.3 to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondent No.3 is directed to decide the legal notice dated 22.12.2019 (Annexure P-4) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
