For the reasons mentioned in the application, same is allowed and delay of 119 days in filing the appeal is condoned. Main case 1.
Learned counsel for the appellant submits that the present appeal may kindly be disposed of having been not pressed any further in view of the settled principle of law settled by the Hon'ble Supreme Court of India in Civil Appeal No.1984 of 2022, titled as "Shyam Sel and Power Ltd. and another Vs. Shyam Steel Industries Ltd." according to which letters patent appeal is VANITA 2026.04.23 17:11 I attest to the accuracy and authenticity of this order and judgment
LPA-258-2020 (O&M) not maintainable against the interim order.

Learned counsel for the appellant further submits that direction be given to the Registry at least for listing the main writ petition so that no further prejudice is caused.

Learned counsel for the respondent raises no objection for the grant of such relief.

In view of the above, as prayed for, the present appeal is disposed of having been not pressed. The Registry is directed to list the writ petition within a period of two years.
