This revision petition has been filed against the concurrent conviction of the petitioners under Sections 326, 325, 324 & 323 IPC in case FIR No. 81 dated 7.6.1995 registered at Police Station Zira. The maximum sentence awarded to both the petitioners is two years rigorous imprisonment and a fine of ` 500/- each. Learned counsel for the petitioners has very fairly argued that he would not press the petition on merits but prays for leniency in the sentence awarded to the petitioners. Criminal Revision No. 1781 of 2004 months and 17 days out of the total sentence of two years. As regards petitioner No.2-Jaswinder Singh alias Momu, he stated that he is a young man and it was his only offence and has undergone one year four months & three days out of the total sentence of two years. In the circumstance, he has prayed that the sentence awarded to the petitioners be reduced to that which they have undergone. Learned Assistant Advocate General has, however, not denied these factual assertions and though both the Courts below have granted the concurrent sentence, yet keeping in view the facts, no case is made out for reduction of sentence.
After hearing both the parties, in my opinion it would be in the interest of justice to reduce the sentence of petitioner No.1-Chand Singh to that which he has already undergone and of petitioner No.2Jaswinder Singh alias Momu from two years to one year & six months. Let petitioner No.2 be now arrested to serve out the remaining period of sentence.
With the above modifications in the sentence, the revision petition stands disposed of.
