This is the second petition under Section 482 of BNSS, 2023 for the grant of anticipatory bail to juvenile 'KXXXX' in connection with NCB Crime No.35/2025 dated 17.09.2025, registered under Sections 8, 21, 29 and 61/85 of the NDPS Act, 1985, pending with the Narcotics Control Bureau, Amritsar Zonal Unit, New Amritsar.

Perusal of the record shows that pursuant to the interim order dated 16.03.2026 passed by this Court, the petitioner has joined the investigation.

Learned State counsel, on instructions from the Investigating Officer, has submitted that though the petitioner has joined the investigation, however, he is not fully cooperating as he has not handed over the mobile phone allegedly used in the commission of the crime. CRM-M-7495-2026 custodial interrogation of the petitioner does not appear to be required at this stage. The aspect regarding non-production of the mobile phone and the extent of cooperation by the petitioner shall remain subject matter of investigation.

Accordingly, without commenting upon the merits of the case, the interim order dated 16.03.2026 granting interim anticipatory bail to the petitioner is made absolute, subject to the conditions envisaged under Section 482(2) BNSS/438(2) Cr.P.C. The petitioner shall continue to join and cooperate with the investigation as and when called upon to do so and shall also produce the mobile phone, if so required by the Investigating Officer.

Accordingly, the present petition is disposed of. 7.
