Ms. Kirti Singh, DAG, Haryana.

(Presence marked through video conference) *** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of mandamus directing the respondents to restore services of petitioner on the post of part time Sweeper as per D.C.Rates.

Petitioner was initially appointed in the year 1995 on the post of Part Time Sweeper on DC Rates. Since then no regular employee has been appointed on the said post. However, the services of the petitioner have yet been summarily terminated by the respondent on 01.12.2021. Hence, the instant petition.

On advance service, learned State counsel appears and submits that competent authority shall take appropriate decision, by treating the present writ petition as a representation of the petitioner, in due course. 4.

Learned counsel for the petitioner also agrees that let a final decision be taken, by the competent authority by treating the present writ petition as a representation.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner and also contentions raised in the present petition by treating the same as a representation and take a decision, in accordance with law, as expeditiously as possible.

It is expected of the respondents to sympathetically consider the mitigating circumstances as more particularly enumerated in the petition. 8.
