The petitioner seeks the concession of pre arrest bail in a case registered at the instance of Pinki alleging that her husband Mohan Lal has committed suicide. As per the allegations in the FIR, husband of the complainant was doing the business of committees and the petitioner being member of 12 committees of Rs.50,000/- each, had picked up all the committees and thereafter he had not been making any payment, as a result of which other members used to visit the deceased's house for getting their money back. When the complainant demanded the money from the petitioner, he had been making false excuses and refused to pay any money, on account of which deceased Mohan Lal came under depression and committed suicide by consuming poisonous substance.

Counsel for the petitioner submits that even if the allegations are presumed to be correct, no offence of abetment is made out against the petitioner. He has made reference to judgments contending that in the circumstances of the present case, even the FIR is liable to be quashed. I have heard counsel for the parties and gone through the police file brought by HC Nasib Singh. A perusal of the police file indicates that the petitioner had been in constant contact with the deceased regarding committees. The act of the petitioner in pressurizing the deceased to end his life is indicated from the suicide note left by the deceased. Prima facie the involvement of the petitioner, on account of his acts qua the deceased, compelling him to end his life, do no warrant to grant the concession of pre-arrest bail to the petitioner. Dismissed.

Interim order is vacated.
