The petitioner claims that on account of dispute between complainant Rimple Joshi and her husband Rajiv Joshi, he has been falsely implicated in the case.

Counsel for the complainant has intervened to contend that the petitioner in connivance with Rajiv Joshi has thrown out the girls, who were occupants of the house after committing theft of the articles of the complainant in connivance with Jangi Ram and others. Counsel for the petitioner has submitted that the petitioner has got nothing to do with the dispute between Rimple Joshi and Rajiv Joshi and that he undertakes to hand over the vacant possession of the house to the investigating officer. He also submits that the petitioner has got no objection in case the controversy between Rimple Joshi, her husband Rajiv Joshi or any alleged occupant is settled in accordance with law. S.I. Mohan Lal informs that the petitioner has joined the investigation. It does not appear to be a case of custodial interrogation. Accordingly, the petition is allowed and it is ordered that in

Cr. Misc. M 10118 of 2016 case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. The petitioner, as per undertaking given by him, would hand over the keys of the vacant portion of the property, in his possession, to the investigating officer within a period of 15 days, without prejudice to the rights of the parties to deal with the property in accordance with the respective rights. The petitioner will also not directly or indirectly threaten the witnesses. In case of violation of any of the above said conditions, it will be open to the complainant to approach this court for cancellation of bail.
