Dispute is between families of two brothers.
Petitioner-Ranjit Singh has been attributed gandasi blows to the injured complainant-Jagjit Singh, i.e. one incised wound below the left knee and the other one on the fingers of right hand. As far as Gagandeep Singh is concerned he is attributed injury with a dang on the wrist and hand of the injured complainant which have been opined to be simple in nature. CRM-M 1012/2016 petition qua petitioner no.1-Ranjit Singh and restricts prayer for the claim of petitioner no.2-Gagandeep Singh.
In view of the above, petition qua petitioner no.1-Ranjit Singh is dismissed as not pressed.
Without commenting upon the merits of the case, keeping in view the injury attributed to petitioner no.2-Gagandeep Singh it is held that he is entitled to grant of anticipatory bail. In view of the above, present petition qua petitioner no.2Gagandeep Singh is allowed and it is ordered that in the event of arrest of Gagandeep Singh, he shall be released on bail on furnishing adequate bail and surety bonds to the satisfaction of the Arresting/Investigating Officer/Trial Court. Petitioner no.2-Gagandeep Singh shall appear before the I.O., as and when called upon for investigation and shall also be bound by all the conditions stipulated in Section 438(2) Cr.P.C.
