(ORAL) Petition was filed in the year 1999, inter alia, for issuance of a writ in the nature of certiorari to quash two lists i.e. of April, 1999 and October, 1999, of a total of 8 candidates, sent by respondent No.2 to the respondent No.3 for making selections to the H.C.S. (Executive Branch) for three vacancies of the year 1998 and seeking directions to respondents No.1 and 2 to first evolve a lawful criteria and then make fresh selection from the list to be sent to the H.P.S.C. by considering all 50 candidates in a lot.

Petition was filed in the year 1999 and has been lying admitted since 04.07.2001.

When called out for hearing, there is no representation on behalf of petitioner. It seems that by sheer effluxion of time and pendency of the writ petition for more than 22 years before this Court, it has been rendered infructuous and/or petitioner seems to have lost interest in pursuing the same. 4.

In any case, it appears that even on merits, claim of the petitioner is not admissible in view of the following stand taken in para No.7 of the written statement filed on behalf of respondent No.3, which is reproduced herein for ready reference:

"7. That the contents of para 7 of the writ petition do not relate to the Answering Respondent. However, it is submitted that the Respondent No.2 vide letter dated 9/4/99, forwarded the list prepared on 8/4/99 containing the names of 6 persons namely Respondents No.6 to 11 to the Answering Respondent for the recommendation in respect of three most suitable persons ASHISH 2022.05.24 17:41 I attest to the accuracy and integrity of this document

CWP-14953-1999 (O&M) -2in order of merit in accordance with the provisions of 1930 Rules. Thereafter, the respondent No.2 vide proceedings of the said Committee dated 4/10/99 included the names of Respondents No.4 and 5 in the list prepared on 8/4/99 and sent on 9/4/99 to the Answering Respondent to recommend three names for recruitment to the HCS (Executive Branch) from Register A-II for the vacancies pertaining the year 1998. Shri Arjan Dass and Shri Mange Ram have filed CWP No.7428 of 1999 in this Hon'ble Court. This Hon'ble Court vide order dated 28.10.1999 directed that the petitioners in the said writ petition shall provisionally be interviewed. In this manner, the Answering Respondent interviewed 10 candidates in all for recommending 3 names for recruitment to the HCS (Executive Branch) from Register A-II for the vacancies pertaining to the year 1998." 5.

I am in agreement with the stand taken by the respondent-HPSC as aforesaid. The same in any case has not been controverted either by way of replication or by way of any additional affidavit. 6.

In view of the aforesaid, no ground for interference is made out. Petition is dismissed.
