After arguing at some length, the learned counsel representing the parties have come to a consensus.

The trial Court has permitted the defendant No.4, to crossexamine the witnesses of the plaintiff as well as the defendant No.3 and 5 in a pending suit filed for declaration with a consequential relief of permanent injunction. All the parties to the litigation are the members of a family. The right of cross-examination has been given to defendant No.4 as he was previously proceeded against ex parte, which order has been set aside. 3.
The learned counsel representing the respective parties jointly state that let defendant No.2 be granted an opportunity to further crossexamine the witnesses after defendant No.4 has cross-examined the aforesaid witnesses. Civil Revision No. 1195 of 2020 opportunities to complete the cross-examination of the witnesses. 4.
Keeping in view the aforesaid facts, the revision petition is disposed of. The trial Court is directed to give an opportunity to the petitioner (defendant No.2) to further cross-examine the witnesses after the defendant No.4 has completed his cross-examination. 5.
Taking note of the fact that the suit is pending for the last ten years, the trial Court is directed to make a sincere endeavour for concluding the trial within a period of nine months, from today. (Anil Kshetarpal) Judge August 30, 2022 "DK"
