" Protection of Women from Domestic Violence Act, was filed, which has since been disposed of by the Family Court and the maintenance was fixed. However, the respondent did not comply with the said order and as such, the execution petition bearing No.56/2020 was filed and arrest warrant have been issued. Also, it is submitted that revision petition has also been filed qua the order passed on the petition filed under the Protection of Women from Domestic Violence Act, for seeking enhancement of maintenance is also pending in the Courts at Jhajjar.
In the given circumstances, it is submitted that it is difficult for the applicant to commute a distance of about 70 kilometres, to defend the divorce petition, more particularly, while taking care of the school-going children.
In view of the aforesaid fact situation and also considering the position of law about preference to be given to the convenience of the wife in the transfer applications relating to the matrimonial dispute, more particularly, when the respondent has not appeared to contest the application despite service, the transfer application is allowed and !
