Learned State Counsel has filed affidavit of Aditya Warrier, IPS, Assistant Superintendent of Police, Dinanagar, District Gurdaspur on behalf of respondent- State. Para No.4 of the said affidavit reads as under:- "That it is humbly submitted that in compliance of above said order, the petitioner appeared in the offence of the deponent alongwith his Passport bearing No.A0285995 in the above said case on 23.12.2022. On perusal of the passport, at the time of occurrence, the petitioner was residing abroad (Doha Katar) and not present at the time of occurrence. Therefore, the petitioner has been found to be innocent in this case vide case diary No.23 dated 23.12.2022 and issued directions to SHO Police Station Dinanagar to submit the supplementary challan under Section 173(8) Cr.P.C in the learned Court and application filed in the learned Court for discharge of the petitioner."
In the light of above-said stand taken by the respondent,
CRM-M-9878 of 2022(O&M) -2statement is made by learned counsel for the petitioner to withdraw the petition.
Dismissed as withdrawn as prayed for, in the light of the reply filed by the respondent.
