Learned senior counsel for the petitioner submits that in the present petition, the challenge was to the order by which the petitioner was compulsorily retired and keeping in view the interim order passed by this Court, the petitioner has already continued in service till the date of his superannuation and the petitioner has already retired on attaining the age of superannuation on 31.01.2021 hence, the present petition has been rendered academic qua the order impugned.

Learned State counsel submits that once the petitioner has already discharged the duty under the interim order passed by this Court, the question of deciding whether the petitioner could have been retired compulsorily or not has been rendered academic hence, impugned order will not be given effect to but the question of law be kept open. 3.
Keeping in view the facts and circumstances of the present case the issue raised in the present petition has been rendered academic and the present petition is disposed of with the observations that no further orders are required to be passed and question of law raised in the present petition is kept open.

Ordered accordingly.

Civil Miscellaneous application pending, if any, shall also be disposed of.
