(Oral) This order will dispose of aforesaid two petitions as the prayer in both the petitions is made under Section 482 Cr.P.C. for quashing of order dated 03.03.2011 (Annexure P-2) declaring petitioners as proclaimed offenders in FIR No. 50 dated 20.04.2002 for offences under Sections 431, 432, 427, 506, 148 and 149 of Indian Penal Code (IPC) and Section 3 of Damage of Public Property Act, registered at Police Station Dasuya, District Hoshiarpur.
It is submitted that in terms of interim directions issued by this Court on 12.04.2013 and 31.05.2013 in respective JITENDER KUMAR 2015.07.29 15:07 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-12066 of 2013 -2petitions, the petitioners are stated to have appeared before the trial Court and furnished bail bonds to its satisfaction and thereafter, they are regularly appearing. The case is fixed for evidence of prosecution for 28.07.2015.
In view of aforesaid circumstances and that the interim concession was granted more than two years ago, the instant petitions are allowed and the impugned order dated 03.03.2011, declaring petitioners as proclaimed offenders is set aside with a condition that petitioners would keep on appearing on each and every date of hearing before the trial Court and would not commit any act which may have the result of delaying the progress of trial. The bail bonds furnished before the trial Court shall continue during pendency of trial. July 28, 2015 ( R.P.
