**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 105 dated 17.6.2017 registered at Police Station City Gurdaspur, District Gurdaspur under Sections 376, 120-B IPC.

Counsel for the petitioner contends that the petitioner was not named in the FIR or in the statement made under Section 161 Cr.P.C. and two persons namely Raju and Lamba Masih were named but subsequently in the statement under Section 164 Cr.P.C., the prosecutrix had made a statement that the petitioner had helped the main accused in committing rape upon her and that she had been giving assurance that Raju would marry her. Counsel also submits that Raju was already married and allegations of conspiracy have been made which they will have to prove at the trial. He urgers that the petitioner is in judicial custody and the trial would take time. The name of the petitioner has cropped up at a later stage. Crl. Misc. No. M-10200 of 2018 -2Raju is stated to be married and having children. Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
