**** VIKAS SURI , J. (Oral) CM-4834-C-2024 This is an application under Section 151 CPC for withdrawal of the Regular Second Appeal.

It is pleaded that the present appeal has been filed impugning the judgment and decree dated 18.11.2019, passed by the learned Additional District Judge, Ambala, and also the judgment and decree dated 06.01.2017, passed by the learned Civil Judge (Senior Division) Ambala, whereby the suit for permanent injunction was dismissed and the appeal preferred thereagainst was also dismissed. It is further pleaded that with the intervention of respectables, the SANGEETA 2024.05.23 10:48 I attest to the accuracy and integrity of this order/judgment

dispute between the appellant and the respondents has been amicably settled and the applicant-appellant does not want to pursue the main appeal.

For the reasons mentioned in the application, supported by the affidavit of the appellant and the present application having been filed through the original counsel, the same is allowed. On the oral prayer of learned counsel for the applicant-appellant, the date of hearing in the main case is preponed from 16.05.2024 to today and with his consent, the same case is taken on board.

CM stands disposed of.
