(ORAL) At the very outset, learned counsel for father/respondent No.2 submits that given his client's advanced age of 87 years, he does not oppose the setting aside of impugned ex parte order dated 13.02.2019 (Annexure P-3) and the Tribunal be granted liberty to proceed afresh, provided petitioners do not deliberately delay the proceedings before the Tribunal. 2.
In the premise, the impugned order dated 13.02.2019 (Annexure P-3) passed by the Tribunal is hereby set-aside. The case is remanded back to the Tribunal with a direction to dispose of the same after hearing both the sides, in accordance with law. The parties shall cause appearance before the Tribunal on 09.03.2021.

In the parting, it is expected of the Tribunal to dispose of the proceedings, as expeditiously as possible, given that respondent No.2 is a senior citizen aged 87 years, preferably within a period of six months. 4.
