Present petition has been filed under Article 226 of the Constitution of India, for issuance of a writ in the nature of Habeas Corpus directing respondents No.2 & 3 to release the detenue namely Rohit Kumar Saini / husband of petitioner from the illegal detention of respondents No.4 and 5.

Mr. Devinder Singh, Advocate has put in appearance on behalf of respondents No.4 and 5 and has filed Vakalatnama, which is taken on record. He submits that the detenue is residing with his parents and is not in illegal custody of respondents No.4 and 5.

Learned State counsel has filed status report dated 01.03.2026 by way of an affidavit of Shri Vijay Singh, DSP, SDPO, North East, and submitted that statements of detenue and his parents have been recorded (Annexure R-1 to R-3). The detenue has clearly deposed in his statement that GEETA RANI 2026.03.12 17:14 I attest to the accuracy and authenticity of this order/judgment Punjab & Haryana High Court at Chandigarh

CRWP-1437-2026 (O&M) ( 2 ) he is residing with his parents of his free will and volition, and specifically denied any illegal detention.
