(ORAL) On 15.03.2023, the following order was passed :- "xxxx The petitioner has filed the present petition under Section 438 of the Cr.P.C. for grant of anticipatory bail in case FIR No.27 dated 16.01.2023 registered under Sections 420, 120-B of the IPC and Section 24 of the Immigration Act (to which Sections 467, 468 and 471 were added later on) at Police Station Sector36, Chandigarh. Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. The petitioner has not received any amount from the complainant. Even otherwise, the matter has already been compromised between the parties. The offences are triable by the Judicial Magistrate First Class.

Co-accused Parshant Sethi and Rajat, who have taken the money from the complainant, have already been granted regular bail by the trial Court vide order dated 31.01.2023. Nothing is to be recovered from the petitioner and his custodial interrogation is not required in the case. The petitioner is already ready and willing to join the investigation. CRM-M-9073-2023 -22023:PHHC:085127 Status report by way of an affidavit of Sh. Charanjit Singh Virk, Deputy Superintendent of Police (South-West) has been filed in the Court today which is taken on record. Adjourned to 06.07.2023.

In the meanwhile, the petitioner is directed to join the investigation and appear before the Investigating Officer within 10 days from today and on his doing so, the petitioner shall be released on interim anticipatory bail subject to his furnishing personal/surety bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall also abide by the conditions as specified under Section 438(2) of the Cr.P.C." 2.

Today, Ld. State Counsel on instructions from SI Naveen submits that the petitioner has already joined investigation and is no more required for custodial interrogation.

In the circumstances, the order dated 15.03.2023 is made absolute, subject to the conditions as enumerated under Sections 438(2) Cr.P.C.

The petitions stands disposed off.
