R.P. Nagrath, J. (Oral) After arguing for sometime, learned counsel for the applicant seeks to withdraw the instant application and the appeal. It is, however, submitted that there are observations of the trial Court with regard to possession over the property in question. These observations are, however, meant only for determining the charges against the applicant in the criminal case and obviously would not have much bearing on merits of the civil proceedings/suit which may be filed by the applicant-appellant with regard to property in dispute.
With the above observations, the application under Section 378 (4) Cr.P.C. is dismissed as withdrawn. Consequently, the appeal against acquittal would stand dismissed. April 07, 2015 ( R.P.
