Learned counsel for the petitioner does not press the instant application as the same has been rendered infructuous because the main petition is fixed for today.

CRM-M-10301-2018 The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.110 dated 06.05.2017 registered for offences punishable under Sections 148/149/302/120-B of Indian Penal Code (for short, "IPC") at Police Station Salhawas, District Jhajjar.
Heard.
Learned counsel for the petitioner submits that other coaccused, namely, Parkash @ Paramjeet and Pawan with similar allegations JITENDER KUMAR 2018.08.08 16:57 I attest to the accuracy and authenticity of this document HIGH COURT, CHANDIGARH
CRM-M-10301 of 2018 -2have already been allowed regular bail vide order dated 30.01.2018 passed by this Court in CRM-M-2707-2018 and vide order dated 27.02.2018 passed by learned Additional Sessions Judge, Jhajjar. He seeks bail for the petitioner on parity with aforesaid co-accused. Learned State counsel has not contested submissions of learned counsel for the petitioner and has fairly conceded that allegations against petitioner are at par with other co-accused, namely, Parkash @ Paramjeet and Pawan.
Parkash @ Paramjeet has been attributed injury with danda blow on head of the deceased while petitioner has been attributed slaps and fists blows.
In view of submissions of learned counsel for the petitioner, learned State counsel and applying the principle of parity, the present petition is allowed. Petitioner-Ravi is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.
(b) In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) He shall not leave the country without the previous permission of the Court.
