versus State of Haryana and another ....Respondents Coram :

HON'BLE MR. JUSTICE PANKAJ JAIN Present :

None for the petitioners.

Mr. Ramesh Kumar Ambavta, AAG, Haryana.

Mr. Suresh Kumar Kaushik, Advocate for respondent No.2. *** PANKAJ JAIN, J. (ORAL) [1] Learned counsel for respondent No.2 submits that the present petition filed under Section 482 Cr.P.C., impugning the summoning order has been rendered infructuous in view of the fact that the trial has almost reached its conclusion. Rather the petitioners challenged the order passed by the learned Trial Court under Section 311 of the Cr.P.C. for recalling of the witness and as a consequence thereof, witness is stand recalled and the statement of witness summoned by invoking Section 311Cr.P.C. also stands recorded.

[2] None has come present on behalf of the petitioners. [3] In view of the above, no further order is required to be passed. [4] Disposed of.

[5] However, liberty is granted to the petitioners to raise all pleas before the learned Trial Court at the appropriate stage. (PANKAJ JAIN) JUDGE 16.04.2024 'R. Sharma'
