The present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to decide/consider the objections and representation of the petitioners, Annexure P-12 and P-13 before finalising the seniority list of the post of the foresters.

Learned counsel would contend that the petitioners, who are working as Foresters, having been appointed on 15.12.2016, have been placed below the promotees and adhoc in the tentative seniority list dated 27.12.2023, Annexure P11, while it was correctly framed in the seniority list dated 18.08.2023, Annexure P-10. He submits that though objections, Annexure P-12, were filed in the stipulated time, followed by a representation, Annexure P-13 but these have not been decided. He thus, at this stage, on instructions, submits that the petitioners are sanguine of it being considered in a positive manner, in case, a direction is given to the respondents to decide the same in a time bound manner by granting them an opportunity of hearing.
