(ORAL) Through this petition under Section 439 Cr.P.C., prayer has been made for grant of interim bail to the petitioner till 27.02.2019 to arrange the marriage function of his sister, which is going to be solemnized on 22.02.2019 in FIR No.450 dated 19.05.2018, under Sections 147, 148, 302, 325, 324 and 323 IPC, Police Station City Sirsa.

Notice of motion.

At the asking of the Court, Mr. R.K. Makkar, Sr. DAG, Haryana, has accepted notice on behalf of the respondent-State. Copy of the paper book be supplied to learned State counsel, during the course of the day.

Learned counsel for the petitioner contends that father of the petitioner expired on 18.06.2018. One younger brother of the petitioner is aged about 17/18. Some particular arrangements for the marriage of his sister are to be made by the petitioner. Therefore, he may be granted interim bail.

Considering the above submissions, impugned order dated 30.01.2019 is modified to the extent that petitioner shall be released on interim bail for 4 days from today on his furnishing personal bonds with heavy sureties to the satisfaction of trial Court/Duty Magistrate concerned, with the direction to the petitioner to surrender at Jail Gate after expiry of 4 days from today at 5:00 P.M. However, the petitioner shall be kept under surveillance by the police in civil dress. Copy of this order be given under the signature of Court Secretary of this Bench.
