(Oral) At the outset, learned counsel for the petitioner prays for withdrawal of the petition with liberty that the petitioner be permitted to place on record the said evidence, as held by the Court below and in accordance with the provisions of the Indian Evidence Act and the Information and Technology Act. However, the impugned order of rejection of his prayer be not considered.
In light of the above, the present petition is dismissed as withdrawn, with the liberty to the petitioner to place on record the CD, strictly in accordance with law, which the trial Court shall consider, if so approached by the petitioner, as per the provisions of law.
