The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to grant one notional annual grade increment on completion of one year service in the month of December of the respective year, re-fix his pay and consequently revise the retiral benefits.

The petitioner is ex-employee of respondent-Bhakhra Beas Management Board. He has retired on attaining the age of superannuation. The petitioner is seeking one notional annual grade increment on the ground that he has completed 1 year service in the month of December and increment was granted w.e.f. January.

Learned counsel for the respondent asserts that he has no objection, if petition is disposed of with a direction to respondent to decide legal notice of the petitioner in a time bound manner and in view of judgment of Supreme Court in C.P. Mundinamani and others (supra). 8.
In the wake of statement of both sides, the present petition stands disposed of with a direction to respondent to decide claim of the petitioner within 3 months from today. The Competent Authority is expected to consider judgment of Supreme Court in C.P.
