(Oral) Quashing of FIR No. 02 dated 06.01.2016 under Section 304-B IPC, registered at Police Station Cheema, District Sangrur, is being sought on the basis of compromise deed dated 20.02.2016 (P-2) Learned counsel for the petitioner contends that at the time of committing suicide, the daughter of the complainant was in her father's house and this fact has been duly mentioned in the FIR (Annexure P-1). Learned counsel for the petitioner also states that complainant Jiwan Singh at the stage of investigation has decided not to pursue with the criminal proceedings, initiated in the FIR. He further contends that the challan has not been presented so far.
However, at the stage of investigation, the matter has been duly compromised, on the basis of compromise deed dated 20.02.2016 (P-2) In compliance of order dated 23.11.2016, report dated GAURAV ARORA 2017.04.07 12:38 I attest to the accuracy and integrity of this document Chandigarh
Crl. Misc. No. M-10514 of 2016 23.03.2017 of Sub Divn. Judicial Magistrate, Sunam has been received in this regard. As per report, statement of the complainant and petitioner have been recorded and they stated that the matter has been duly compromised between them. The compromise has been entered voluntarily. The complainant has no objection if the F.I.R be quashed against the petitioner. Consequently, in view of the status report dated 23.03.2017 and in view of the judgment of the Hon'ble Supreme Court in cases of Dr. Arvind Barsaul etc. versus State of Madhya Pradesh and another 2008(2) RCR (Criminal) 910, Madan Mohan Abbot vs. State of Punjab 2008(2) RCR (Criminal) 429 and the law laid down by the Full Bench of this Court in the case of Kulwinder Singh and Ors. vs. State of Punjab and another 2007(3) RCR (Crl.) 1052, no useful purpose would be served in prolonging the litigation, as the matter stands compromised between the parties amicably.
Accordingly, FIR No. 02 dated 06.01.2016 under Section 304-B IPC, registered at Police Station Cheema, District Sangrur, is quashed along with all consequential proceedings arising therefrom qua petitioner.
The petition stands disposed of.
