H. S. Madaan, J. (Oral) As per intimation received from the trial Court, the trial is at advanced stage and only three prosecution witnesses remain to be examined.

Under the circumstances, counsel for the petitioner states that he be permitted to withdraw the present petition. However, a direction be issued to the trial Court to conclude the trial expeditiously.

In view of the above, the petition stands dismissed as withdrawn.

However, the trial Court is directed to make earnest efforts to conclude the trial expeditiously, by giving short BANITA CHUGH 2022.08.26 16:47 I attest to the accuracy and integrity of this order/judgmentt

CRM-M-9188 of 2022 -2adjournments. If it is found that the remaining prosecution witnesses are not appearing in the Court despite issuance of summons to them, the trial may resort to issuance of coercive process against them to secure their presence.

The State counsel has been directed to ensure that remaining prosecution witnesses are produced in the Court on the dates so fixed by the trial Court. Of course, the accused shall not seek adjournment for cross examination of those prosecution witnesses and if some adjournment is sought, which is found to be without any justifiable reason, then the request may be declined by giving reasons mentioned in the interim order.

The necessary exercise be completed preferably within three months from the date of receipt of the copy of this order. A copy of the order be sent to the trial Court though District and Sessions Judge, Sangrur, for information and necessary action.
