(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.0046 dated 07.08.2016 registered under Sections 323, 324, 326, 148 and 149 IPC at Police Station Khilchian, District Amritsar Rural, on the basis of compromise (Annexure P-2). Pursuant to order dated 07.02.2018 of this Court, the parties appeared before the trial Court/Illaqa Magistrate on 20.02.2018 to get their statements recorded. Learned Sub Divisional Judicial Magistrate, Baba Bakala Sahib, District Amritsar, has submitted her report vide letter bearing No.663 dated 28.02.2018 duly forwarded by learned District and Sessions Judge, Amritsar vide Endst. No.1962R dated 01.03.2018.
According to the report, learned Sub Divisional Judicial Magistrate, Baba Bakala Sahib, is satisfied that parties have arrived at compromise voluntarily, out of their free will and without any pressure or Ravinder Singh 2018.07.23 15:08 I attest to the accuracy and authenticity of this document coercion and the same is genuine.
Considering the report of learned Sub Divisional Judicial
-2CRM-M-1045 of 2018 Magistrate, Baba Bakala Sahib, and the fact that the compromise will bring peace and harmony in relations between the parties, FIR No.0046 dated 07.08.2016 registered under Sections 323, 324, 326, 148 and 149 IPC at Police Station Khilchian, District Amritsar Rural, is hereby quashed, subject to payment of costs of `10,000/-, out of which `6,000/- shall be deposited with the Punjab State Legal Services Authority and `4,000/- with the Bar Council of Punjab and Haryana.
Petition is disposed of accordingly.
List on 31.8.2018 for production of receipt with regard to deposit of aforesaid costs.
