(Oral) Petitioner has filed this petition under Section 482 of the Code of Criminal Procedure, 1973 for issuance of directions to respondents no.3 to 5 to arrest the accused persons in case FIR No.0176 dated 14.10.2019 under Sections 306, 148, 149 IPC registered at Police Station Ajnala, Amritsar Rural, District Amritsar.
Learned counsel for the petitioner has argued that after registration of the aforesaid FIR, the accused persons are roaming freely in the village and are giving threats to the petitioner and her family members and therefore, they are required to be arrested. Criminal Misc. No. M-7241 of 2020 -2The FIR in question was registered on 14.10.2019. However, except the present FIR, there is no such material, including post-mortem examination conducted on the person of the deceased, before this Court. In absence of any such material, it is presumed that the matter must be under investigation and therefore, the prayer made in this petition to direct the respondents to arrest the petitioner, cannot outrightly be accepted.
