The applicant has come up against the judgment of acquittal dated 17.02.2017 passed by the trial Court, under Section 378(4) Cr.P.C. 2.

Notice to the respondent served time and again which is received back with the report of incorrect address.

Sufficient time was granted to the petitioner to serve upon the respondents but he failed to do so.

On the last date of hearing, the applicant was directed to file correct address alongwith process fee but he failed to do so. 5.

Given above, present leave to appeal is dismissed with liberty reserved to the applicant/appellant to file fresh one after filing of correct address of the respondent within a stipulated period of one year from the date of this order, in accordance with law. 6.

It is clarified that dismissal of present leave to appeal shall not come in the way of the applicant/appellant.
