Learned counsel for petitioners/guarantors is before this Court seeking issuance of a writ in the nature of certiorari for setting aside/quashing the possession notice dated 19.12.2025 (Annexure P-9) issued by respondent no. 3 and for consequential directions for restoring possession of the property in question to the petitioners/guarantors.

It is not disputed by learned counsel for petitioners that S.A. No. 81 of 2020 titled 'Sandeep Jindal and Another versus Punjab National Bank and others' has been filed by the petitioners/guarantors and the same is presently pending adjudication before the Debts Recovery Tribunal-II, Chandigarh (for short, 'DRT-II, Chandigarh').

In view of above, this Court would not like to prejudice the proceedings before DRT-II, Chandigarh since the same issue is already pending consideration before the said Tribunal. The petitioners/guarantors shall always be at liberty to raise all subsequent events that have happened in relation to the KAMAL GANDHI 2026.03.09 18:02 I attest to the accuracy and integrity of this document
CWP-3807 of 2026 secured asset in support of his case, including by seeking amendment, if so advised, in the aforesaid S.A. No. 81 of 2020. 4.
In view of above, without commenting upon merits of the case, this Court leaves it to DRT-II, Chandigarh to decide S.A. No. 81 of 2020 as expeditiously as possible, in accordance with law. 5.
Accordingly, present petition is disposed of with liberty to the petitioners/guarantors to pursue S.A. No. 81 of 2020 before DRT-II, Chandigarh. 1.
