Short reply by way of affidavit of Sh. Ajay Kumar, IAS, Deputy Commissioner-cum-District Collector, Gurugram filed on behalf of respondent Nos.1 and 2 is taken on record. Registry to scan the same and tag at the appropriate place. Alongwith the affidavit a copy of order dated 11.03.2026 passed by the Deputy Commissioner-cum-District Collector, Gurugram has been appended as Annexure R-1. Operative part of the said order reads as under :

"Therefore, based on the facts stated above, the appeal of the appellant is allowed and the orders dated 11.09.2019 and 17.01.2025/31.01.2025 passed by the Court of Assistant Collector First Class, Pataudi are set JITENDER KUMAR 2026.03.24 14:16 I attest to the accuracy and integrity of this document Chandigarh

CWP-3781-2026 -2aside and the case is remanded to the Court of Assistant Collector First Class, Pataudi with the direction that in the above case, the legal heirs of the deceased respondent Satish son of Shri Balwant be made party and after giving adequate opportunity to be heard and present evidence to both the parties and the Rasta No.110 be demarcated as per Massavi in the presence of both parties and the case be decided on merits within 30 days."

In view of the order dated 11.03.2026 passed by the Deputy Commissioner-cum-District Collector, Gurugram, the present writ petition has been rendered infructuous and the same is disposed off as such. Pending applications, if any, also stand disposed off.
