DEEPAK GUPTA , J.(Oral) Petitioner is in custody since 04.11.2022 in case FIR No.138, dated 27.08.2022, registered at Police Station City Jalalabad, District Fazilka, under Section 304 IPC (Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 added later on). By way of this petition, petitioner is praying for grant of regular bail. Allegations are that deceased Amandeep Singh was habitual of consuming heroin for the last four years, as per contents of the FIR lodged by the father of the deceased. It was disclosed that deceased used to purchase heroin from the petitioner and co-accused. On fateful day i.e. 27.08.2022, Amandeep Singh died after consuming intoxicant.
It is contended by learned counsel for the petitioner that during the last four years, no complaint was ever lodged against the petitioner nor any recovery was effected from him. It is further pointed out co-accused Gurcharan Singh @ Gandri has already been allowed bail by this Court vide order dated 02.02.2023 passed in CRM-M-567892022. Another co-accused Sandeep Singh has also been allowed bail vide order dated 02.02.2023 passed in CRM-M-55114-2022. Petitioner prays for grant of bail on the basis of parity also.
