The petitioner prays for issuance of a writ in the nature of mandamus to re-evaluate his result and award him one additional mark in the written examination.

The petitioner wrote the written examination on 16.10.2021 held pursuant to the recruitment notice dated 03.08.2021 for recruiting the Elementary Teachers' Training cadre. The examination conducted consisted of objective type questions where answers had to be chosen from the multiple options given for each question. The result with the tentative answer key was uploaded on the official website of department on 19.10.2021 while granting an opportunity to the candidates to file their objections. The petitioner submitted the objections with respect to as many as five questions. The Education Recruitment Directorate, after considering DEEPAK KUMAR BHARDWAJ 2023.02.23 09:25 I attest to the accuracy and integrity of this document the said objections, has published the revised answer key.

The learned counsel representing the petitioner contends that in fact, there were two correct answers of question No.1, therefore, the writ be issued.

In the recent judgements rendered by the Supreme Court in Vikesh Kumar Gupta v. State of Rajasthan and Others (2021)2 SCC 309 and Ran Vijay Singh and Others v. State of Uttar Pradesh and Others (2018) 2 SCC 357, it was held that once an opportunity to file the objections has been given and the revised result is published after considering the objections by the Subject Experts, the scope of interference in a writ jurisdiction ceases to exist.

Keeping in view the aforesaid facts, this Court does not find it appropriate to issue the writ. Hence, the present writ petition is dismissed. (Anil Kshetarpal) Judge February 21, 2023 "DK"
