Present petition has been filed under Article 226 of the Constitution, inter alia, seeking issuance of a writ in the nature of mandamus for directing the respondnts to consider the petitioner for appointment as Peon / Sewadar in Govt. Middle School, Village Bulla Rai, Tehsil Guruharsahai, District Ferozepur.
Despite case having been called twice, no one has come present on behalf of the petitioner.
Learned State Counsel produced a copy of order dated 29.06.2020, passed by the competent authority, whereby the claim of petitioner has been rejected and operative part of the same reads as under:- " xxxx In compliance the order of the Hon'ble High Court, the representation (Annexure P-4) of the petitioner thoroughly consider and found that there is no post of Peon / Sewadar is lying vacant and there is no post of Peon/Sewadar is sanctioned in Government Middle School, Village Bulla Rai, Tehsil Guruharshai, District Ferozepur, as well as the department is not competent to appoint any person against the DINESH KUMAR 2022.07.25 10:39 I attest to the accuracy and authenticity of this document vacant post.
CWP No. 4967 of 2020 -2In view of the above position, the claim of the petitioner for the post of Peon / Sewadar is not sustainable and hence same is hereby rejected at this stage." The aforesaid order is taken on record as Mark-X. Registry to do the needful.
A perusal of the aforesaid order clearly reveals that there is no post of Peon/Sewadar lying vacant in the aforesaid school. Hence, the claim of the petitioner stands rejected.
In view of the above, writ petition is disposed off. Needless to say that in case, petitioner feels aggrieved against the above order, he can take recourse in accordance with law. July 21, 2022 ( MAHABIR SINGH SINDHU ) 'dk kamra'
