Mr. Kanwar Satbir Singh, Advocate, for respondent No.2. RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.56 dated 11.08.2015 registered under Sections 333, 353 and 186 IPC at Police Station Rohtak along with all subsequent proceedings arising therefrom, on the basis of compromise. Pursuant to order dated 03.07.2018 of this Court, the parties appeared before the learned Additional Sessions Judge, Rohtak, on 16.07.2018 to get their statements recorded. Learned Additional Sessions Judge, Rohtak, has submitted his report vide letter bearing No.316 dated 16.07.2018 duly forwarded by learned District and Sessions Judge, Rohtak vide letter No.2558 dated 17.07.2018.
According to the statements of the parties, compromise arrived at between them is with their free will and without any pressure from any corner.
Considering over all circumstances and the fact that the RAVINDER SINGH 2018.08.17 16:46 I attest to the accuracy and authenticity of this document compromise will bring peace and harmony in relations between the parties,
-2CRM-M-10519 of 2018 FIR No.56 dated 11.08.2015 registered under Sections 333, 353 and 186 IPC at Police Station Rohtak along with all subsequent proceedings arising therefrom, is hereby quashed, subject to payment of costs of `10,000/-, out of which `6,000/- shall be deposited with the Haryana State Legal Services Authority and `4,000/- with the Bar Council of Punjab and Haryana. Despite specific directions to the trial Court to record its satisfaction about the genuineness of the compromise in between the parties, Sh. Jasbir Singh, Additional Sessions Judge, Rohtak, has not recorded his satisfaction. Therefore, he may be asked to explain the reasons for violating the directions of this Court given to him vide order dated 03.07.2018. Petition is disposed of accordingly.
List on 06.09.2018 for production of receipt with regard to deposit of aforesaid costs and explanation of the learned Additional Sessions Judge, Rohtak.
