**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the petitioner is claiming the interest on the delayed release of the pensionary benefits. Counsel for the petitioner states that all the charge-sheets, by which the pensionary benefits were stopped, have been dropped and therefore, the petitioner is entitled for the interest on the delayed release of the payments. The said claim of the petitioner has been rejected by the Chief Engineer, Irrigation & W.R. Department, Haryana, Panchkula, vide order dated 17.09.2018 (Annexure P-9) holding that as the petitioner has not clearly been exonerated from the charges, he is not entitled for the interest on DCRG and commutation of pension from the date of retirement in view of the Finance Department O.M. dated 20.02.2002. CWP-4517-2019 -2Against the said order, the petitioner has preferred an appeal on 14.08.2017 (Annexure P-10) to the Principal Secretary to Government of Haryana, Irrigation and Water Resources Department. Counsel for the petitioner further states that even after an expiry of more than one year, the above-said appeal has not been decided by the respondents and is still pending consideration with them and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said appeal. In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the appeal dated 14.08.2017 (Annexure P-10) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
