IN THE HIGH COURT OF PUNJAB & HARYANA

AT CHANDIGARH CWP-16384-2000 (O&M) Date of decision: 05.03.2025 HUKAM SINGH AND OTHERS .........Petitioners

VERSUS

PRESIDING OFFICER AND OTHERS ........Respondents CORAM : HON'BLE MR. JUSTICE VINOD S. BHARDWAJ ***** Present:- Mr. B.S. Patwalia, Advocate with Mr. Gaurav Jagota, Advocate for the petitioners.

None for respondents No.2 and 3.

***** VINOD S. BHARDWAJ , J. (Oral) The present writ petition had been filed challenging the Award dated 20.11.1998, confirming the termination of the services of the petitioners in the year 1997.

The writ petition had been filed in the year 2000 and has remained pending since then.

Learned counsel appearing on behalf of the petitioner informs that initially an industrial dispute had been initiated against M/s Ranbaxy Laboratories Ltd., New Delhi which has since then not been taken up and the same was eventually taken over by M/s Sun Pharma. He has, however, been unable to answer the question as to under what circumstances can an award be executed against a juristic entity which has been liquidated as per law. He orally informs that

CWP-16384-2000 (O&M) -2some sort of settlement had been arrived at between M/s Sun Pharma and the management to take over litigation. He, however, submits that despite repeated attempts made by him to seek copy of the settlement order and further instructions, no response is forthcoming. In view of the above, it seems that the petitioners may not be interested any further in pursuing the present writ petition. The same is accordingly dismissed for non-prosecution. Liberty is, however, granted to seek revival of the present writ petition, if any lawful grievance survives against the respondents.

All the pending miscellaneous application(s), if any, are also disposed of.
