**** JASJIT SINGH BEDI, J. (Oral) On 10.04.2023, the following order was passed:- "The learned counsel for the petitioner submits that the petitioner is ready and willing to join proceedings. List on 09.05.2023."

Thereafter, on 09.05.2023, the following order was passed:- "The prayer in the present petition under Section 482 Cr.PC is for quashing of the order dated 04.1.2010 (Annexure P-3) passed by the Chief Judicial Magistrate, Hoshiparpur, whereby the petitioner has been declared a proclaimed offender in FIR No. 187 dated 30.10.2009 under Sections 323, 324, 341, 148 and 149 IPC at Police Station Model Town, District Hoshiarpur later on the challan was presented under Sectins 323, 324, 341 and 34 IPC. The learned counsel for the petitioner contends that the coaccused of the petitioner has been discharged vide order dated 26.07.2016 (Annexure P-10). He states that the petitioner is ready and willing to join the proceedings once again. Notice of motion for 12.07.2023.

Operation of the order dated 04.12.2010 (Annexure P-3) shall remain stayed till the next date of hearing only. In the meanwhile, the petitioner is directed to surrender before the Trial Court within a period of four weeks from today and subject to a deposit of Rs.2,00,000/- as costs with the Guru Ravidas Sabha, PGI Sector 12, Chandigarh and deposit of his passport, he shall be admitted to interim bail to the satisfaction of the Trial Court."

CRM-M-10338-2022 (O&M) -2On 12.07.2023, the following order was passed:- "The learned counsel for the petitioner prays for some time to place on record certain documents to substantiate his argument that the petitioner was unable to appear before the Trial Court on account of the fact that his application for permanent residency is pending in the U.K. and shall be decided by September, 2023. Let the needful be done within one week.

To come up on 21.07.2023.

Interim order to continue. "

On 21.07.2023, the following order was passed:- "A written request for adjournment has been circulated on behalf of arguing counsel for the petitioner on the ground that he is in some personal difficulty.

Adjourned to 17.01.2024.

Interim order to continue."

Despite the assurance of the petitioner that he would surrender before the Trial Court and thereafter he would be admitted to interim bail, the petitioner has not bothered to do so.
