Mr.Sunil Agnihotri,Advocate for the respondent. Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail to the petitioners who have been summoned vide order dated 20.1.2016 (P-2) to face trial in complaint case no.258/2014 dated 19.8.2014(P-1) under Sections 420,465,467,468,471,120-B IPC.
The dispute is regarding the alleged forged Will dated 18.3.2009 executed by the father of the complainant. It was submitted that this Court vide order dated 21.3.2016 has already directed trial court to grant interim bail to non-applicants co-accused Bula Masih and others.
Vide order dated 30.3.2016 while issuing notice of motion it was directed that in the event of surrendering before the trial court RAJINDER PRASHAD JOSHI 2016.04.27 11:18 I attest to the accuracy and authenticity of this document High Court, Chandigarh.
CRM-M 10715/2016 within 10 days, petitioners be released on interim bail. At the time of hearing today,learned counsel states that in compliance of the said order, petitioners surrendered before the trial court on 6.4.2016 and were released on interim bail. Learned counsel for the respondent is unable to refute the said factual position.
In view of the above interim bail granted by the trial court, pursuant to the order dated 30.3.2016, is made absolute. Disposed of.
